Role Summary Global Litigation Counsel--Manage all litigation and claims across global enterprise. Directs strategy but relies on outside counsel to appear in court. Role Accountabilities and Responsibilities (Describe the 5-7 major accountabilities)
  • In the role of Chief Litigation Counsel for the Company, supervise and direct the defense and prosecution of the Company's litigation globally-including multi-million dollar Class Actions, Complex Commercial suits, Antitrust matters, Government Investigations, and Mass Torts-to optimal resolution
  • Manage the Company's litigation in a manner which supports the Company's broader business objectives, with focus on treating each matter as having an "investment thesis" and a tangible and intangible ROI. Aggressively manage litigation-related costs, including attorneys', experts', and third-party fees and expenses, through strong forecasting disciplines. Develop metrics to better understand "demographics" of cases and claims for root cause evaluation and evaluate efficiency and cost effectiveness of claims and litigation management processes
  • Interface with senior management, in-house corporate accounting and outside financial auditors regarding financial implications of the Company's litigation
  • Conduct litigation liability/risk due diligence for company's acquisitions and divestitures to identify material potential liabilities/risks and suggest indemnities or other risk-avoiding or risk-shifting measures, and seamlessly integrate litigation of acquired entities
  • Develop Enterprise Risk Management tools, processes and strategies to successfully decrease/mitigate enterprise-wide exposure to adverse judgments, settlements, class actions, and fines. Improve processes to inform line managers of financial implications of legal risks engendered by product claims, product functionality and product quality for their organizations, and develop the proper incentives for them to reduce legal claims and cases and corresponding legal expenses related to claims and litigation. To fully accomplish this, the individual will have to work closely with the Marketing, R & D, Regulatory and Quality, in addition to understanding the marketplace and where our product and marketing approach fits in.
  • Direct corporate records management globally, supervise e-discovery to ensure legal compliance, coordinate with Information Technology on litigation-related legal technology matters, and oversee use of litigation-related case management, legal hold, e-billing and e-discovery software
  • Supervise outside litigation counsel nationwide and globally and two paralegals internally.
Education and Experience
  • BA/BS and JD Degree from an accredited institution
  • 15+ years primarily of litigation and litigation management experience, of which at least 5 years were spent conducting litigation within a law firm and at least 5 years were spent in house managing litigation
  • Consumer products, pharmaceutical and medical devices industry experience
  • Member of at least one state bar
  • Demonstrated ability of providing "hands on" management and prioritization among all aspects of a large number of cases and claims.
  • Knowledge and experience with lawsuits and claims involving the following areas of law: class actions, complex litigation, antitrust, false advertising, product liability, intellectual property, employment, warranty, contracts, commercial disputes, personal injury, product safety and quality issues, worker's compensation, insurance coverage claims, environmental litigation, vehicle accidents, premises liability, bankruptcy and collections
  • Knowledge and experience with Government investigations and claims, including involving the DOJ, FTC, EEOC, EPA, OSHA, FDA and state Attorneys General
  • Demonstrated ability to identify root causes of, and lead efforts to reduce, litigated claims and improve cost- effective resolution of claims
  • Demonstrated strong leadership, client development, communication, analytic, organization and implementation skills through successful development, implementation and improvement of fundamental litigation processes across functions/organizations.
  • Experience implementing enterprise wide-document management and retention practices for all types of documentation.
  • Thorough knowledge of federal and state court rules, including rules governing E-discovery requirements
  • Familiarity with litigation-related computer software programs-including software relating to legal holds, e-discovery, e-billing and case management-and experience dealing with technology-related legal issues
  • Demonstrated broad business orientation and ability to aggressively establish instant credibility as an attorney, change agent, and business partner with cross functional perspective
  • Effective strategist and tactician in responding to major lawsuits
  • Intense business focus, with a strong work ethic and a passion for understanding the business and contributing in a meaningful way to the business strategy
  • Experience recruiting, hiring, retaining, managing and developing other lawyers and/or support staff
