Responsibilities

The Director, Equal Opportunity will report to the Vice President, Access and Community Engagement. This highly visible role is expected to develop, deliver, and oversee anti-discrimination and harassment programs for the university community, including students, faculty and staff.

The Director is charged with managing the university's compliance with federal and state anti-discrimination laws, regulations and requirements. To that end, this position also serves as the institution-wide Title IX Coordinator, Title VI Coordinator, and the Section 504/ADA Coordinator.

The position will work closely with the Office of General Counsel as well as the Offices of Human Resources, Student Life, and Campus Security.

The position will be primarily located at New York Tech's Old Westbury, New York, campus, but the responsibilities will also cover its campuses in New York, New York and Jonesboro, Arkansas. A hybrid work schedule will be considered.

Specific Responsibilities:

    Maintain overall responsibility for the institution's compliance with applicable federal and state anti-discrimination laws. These include but are not limited to: Title IX, NYS Education Law 129-B, VAWA amendments to the Clery Act, Title VI, Title VII, NYS Labor Law 201-g, NYS Human Rights Law, Section 504 of the Rehabilitation Act, and the ADA.
  • Develop, implement and coordinate campus strategic efforts aimed at the prevention of sexual violence and other forms of sex and/or gender-based discrimination as required under applicable laws.
  • Oversee the development and implementation of training, educational materials, and online resources for students, faculty, and staff regarding applicable federal and state anti-discrimination laws.
  • Receive, review, and assess complaints of unlawful discrimination, harassment or related misconduct by students, employees, members of the campus community, and third parties.
  • Provide follow-up to complaints including proper assistance, referrals, and resolution options to reporting parties; determine the need for an investigation and initial remedial actions; ensure compliance with timelines, notices, and other requirements under applicable laws reflected in New York Tech policies.
  • Conduct prompt, effective and timely investigations (or oversee the investigation by deputy coordinators) of complaints, in coordination with student affairs and/or human resources personnel, as applicable. Prepare formal, written reports of investigation findings in a timely manner.
  • Organize and maintain comprehensive grievance files, disposition reports, and other records necessary for federal and state law compliance, including providing ongoing reports on the number and nature of filed complaints and outcomes.
  • Stay abreast of current and emerging issues and develop plans for ensuring New York Tech policies and practices are in compliance with applicable federal and state anti-discrimination laws and regulations.
  • Oversee and train a system of Deputy Title IX Coordinators, who maintain other full-time responsibilities.
  • Implement the NYS 129-B campus climate survey biennially.
  • Assist and coordinate with Campus Security on Clery reporting, NYS Education Law 129-A, and related federal and state bias/hate crime compliance.
  • Other duties as assigned.


Qualifications

  • Knowledge of, or ability to learn, current state and federal law and regulations, best practices, and trends in the areas of responsibility.
  • Ability to design, deliver, track, and assess training programs, including through the use of technology.
  • Ability to build relationships and balance the interests of varied parties and stakeholders.
  • Ability to identify and effect changes to university policies and practices.
  • Excellent oral and written communication skills, and the demonstrated ability to communicate in a professional, empathetic, and tactful manner.
  • Ability to exercise good judgment and respond appropriately to difficult, confidential, and high stress situations.
  • Strong work ethic and initiative, including the demonstrated ability to work independently with limited supervision.

Education/Experience:

Required: Bachelor's degree and 5+ years of relevant experience in the field of employment law, student affairs, anti-discrimination law, compliance, human resources, investigations, or similar field.

Preferred: Juris Doctorate or advanced degree in a related field; experience conducting trainings and investigations in a higher education setting; ATIXA or other industry trainings/certifications in Title IX or a related field.

USD $115,000.00/Yr.

USD $135,000.00/Yr.
